Durability of Operations in ESI Funds

Description
The European Union, to ensure efficiency, fairness and sustainable impact of the intervention of the ESI Funds has created and updated provisions guaranteeing the durability of investments in business activities and infrastructure, avoiding the use of ESIF for undue advantages. The experience of various EU member countries has shown that this period of five years is the most appropriate minimum period to be used, except for cases where state aid rules provide for a different period.
However, it has been decided to shorten this period down to three years when the investment concerns the maintenance of investment or jobs created by SMEs.
Violation of these rules requires the return of some or all of the ESIF funds. In special cases, the ESIF contributions have to be reimbursed, if, within ten years of the final payment to the beneficiary, the production activity is relocated outside the European Union. There were ESF supported projects exempted from the general durability requirement.
Individual EU countries present their experience in implementing these principles for both the 2007-2013 and 2014-2020 periods. It is worth mentioning that amounts unduly paid should be recovered and should be the subject to procedures applicable to irregularities.
